1. Provider, users and service

The provider is OptiNext Kft., identified above. Contact and complaints: info@optinext.hu. Publsy is browser-based software requiring a current browser, internet access and, for certain features, an appropriate third-party account. Terms are available in Hungarian and English.

Business customers and adult individuals acting outside their trade or profession may use the service. A representative registering for a company confirms authority to act for it. The selected plan determines seats, clients, storage and AI allowances. Availability differs by plan and social platform; the connections and restrictions actually displayed in the service apply.

Publsy does not guarantee audience reach, sales or uninterrupted third-party platforms. The provider remains responsible for conformity of its own service; using a third party does not itself exclude that responsibility.

2. Ordering, activation and saving the contract

Before submitting, review and correct the plan, price, billing and contact details. Unticked acceptance boxes cover these Terms and the Data Processing Terms for client data. Acknowledging the Privacy Notice is not marketing consent. Optional cookies require a separate choice.

Registration leads to payment-method setup on Stripe; submitting it does not itself create an active subscription or prove a charge. The provider accepts the registration order through an activation confirmation. After successful card setup and verification of the Stripe subscription, access to the chosen plan activates automatically without manual provider approval. The seven-day trial starts at activation; technical processing may briefly delay access. The chosen subscription becomes payable automatically after the trial unless cancelled beforehand. Confirmation, checkout and the subscription page show the exact dates and charges.

The contract is concluded electronically and is not a separately executed written agreement. We record acceptance time, language, edition and content hashes. You can download the edition; activation email also contains the full newly accepted Terms and Data Processing Terms. Editions are not retrospectively replaced. Keep your copy. The provider has not adopted a separate code of conduct.

3. Fees, renewal, cancellation and invoicing

The total gross price, currency, billing interval and plan shown before payment apply. A net-plus-VAT breakdown of a HUF gross price explains that total; it does not add VAT again. Check the final tax and price summary for your country and tax status. EUR payment is available only where checkout actually offers it.

A monthly or annual subscription renews automatically at the stated interval. Cancel renewal in the Stripe customer portal reached from Billing, or contact info@optinext.hu if it is unavailable. Cancellation normally takes effect at the end of the paid period. Cancellation by the end of the trial prevents the first subscription charge. Mandatory consumer, conformity and refund rights are unaffected.

Stripe handles payment details; Publsy does not store full card numbers or CVC codes. Electronic invoices are issued through Tacito. Customers must provide accurate billing details. Unpaid amounts may restrict editing, AI use and publishing, as indicated in the interface; non-payment does not itself trigger destruction of data.

Advertising spend, external subscriptions and separately ordered services are excluded unless expressly included. New prices or adverse contractual changes are communicated directly at least thirty days in advance for future periods; you may cancel the next renewal before they take effect. Paid periods and purchased-token expiry dates are not retrospectively shortened.

4. AI generation and token allowances

Publsy tokens are proprietary cost-weighted accounting units, not raw AI model tokens, money or transferable investments. Before generation the interface shows the allowance requested or reserved; final accounting uses confirmed usage. Images and product or character references can increase cost. An authorised workspace member uses that workspace’s allowance.

Included allowances renew monthly. Unused included monthly allowance does not roll over after the period shown in the interface. Separately purchased extra tokens remain usable for one year from payment confirmation, until their displayed expiry. The included monthly allowance is always consumed first, then unexpired extra tokens, earliest expiry first. An extra purchase is one-off, does not start a subscription and does not extend earlier purchases. An active subscription allowing service use is required to spend extra tokens.

Before generating, check reference rights and any depicted person’s permission. The brief, selected images and instructions needed for the request may be sent to an external AI provider, currently OpenAI. A person must check accuracy, brand fit, rights and any required AI disclosure. AI may make mistakes or produce similar outputs for others; exclusivity and copyright protection are not guaranteed. Publsy does not acquire ownership of uploaded material, only the rights needed to process, store and publish as instructed.

Unused reservations caused by technical failure are released. Request review of disputed deductions using the operation identifier; confirmed accounting errors are corrected. The next generation or extra-purchase price is shown before confirmation. There is no unlimited automatic top-up without separate approval. Extra-token rules do not exclude mandatory consumer refund rights.

5. Approval, scheduling and external connections

You must have authority over connected social accounts. Granting and revoking a connection are separate actions. Where approval is required, the current content version must be approved before it can be published. Publishing uses the selected target profiles; merely connecting Facebook and Instagram does not select every profile for every post.

Editors must check time zones and targets. Expired access, platform restrictions, media faults or network failures may delay or prevent publishing. Success requires the destination platform’s confirmed publication; a scheduled state or notification email does not prove publication. The provider investigates and remedies its own technical failures.

Share monthly or individual approval links only with authorised reviewers: possession allows access to the shared material and permitted decisions. The workspace manager is responsible for recipient addresses and authority. External API/OAuth clients access only the authorised client and scopes; draft creation does not itself permit publishing.

6. Consumer withdrawal, cancellation and conformity

A consumer may withdraw without giving a reason within fourteen days after concluding the service contract, or terminate under that right after delivery has begun. Send an unequivocal statement to info@optinext.hu or the provider’s registered office. Sending it within the period is sufficient. A trial does not itself extinguish this right.

For an immediate-access consumer order, a separate unticked box requests commencement within fourteen days. This is not a waiver. This edition does not impose automatic loss of withdrawal rights for AI generation or token use. Legally refundable amounts are returned within fourteen days of receiving the withdrawal/termination statement, normally by the original payment method. A proportionate charge for service already provided may apply only if statutory requirements are met; merely accepting these Terms does not establish such a charge.

Optional model statement: “To OptiNext Kft., 1143 Budapest, Stefánia út 71., Hungary; info@optinext.hu. I withdraw from / terminate my Publsy service contract. Contract date: …; name: …; account email: …; address: …; date: …; signature only for paper submissions.” Do not send card details.

The service must conform to the contract and mandatory law. Where statutory conditions apply, you may request correction, a price reduction or termination and refund for lack of conformity. Mandatory rights under the Hungarian Civil Code and Government Decrees 45/2014 and 373/2021 take precedence. These Terms do not restrict mandatory consumer rights or exclude liability for intentional damage or injury to life, physical integrity or health.

373/2021. Korm. rendelet

7. Security, termination and complaints

Protect credentials and approval links and review team permissions. Unauthorised personal data, unlawful content, malware, impersonation without permission, access circumvention and abusive load are prohibited. For immediate security risks we may proportionately restrict access and, where possible, explain the reason and remedy.

Termination and erasure are different. On termination revoke external connections and request return or deletion of workspace content under the Data Processing Terms. Invoices and records necessary for legal claims remain for their required retention periods. Disconnecting Publsy does not automatically delete content already published on Facebook or Instagram.

Send complaints to info@optinext.hu or the registered office. Written consumer complaints receive a substantive reasoned answer within thirty days. A rejection identifies the competent consumer authority and conciliation board. Consumers may apply to their competent conciliation board or court; we comply with statutory cooperation duties. Current board contacts are listed on the official site below.

Hungarian law applies without removing mandatory protection in a consumer’s habitual residence. We impose no exclusive provider-side court jurisdiction on consumers. This edition does not retrospectively attribute acceptance to existing accounts; material changes require direct notice and acceptance where necessary.
